1. Acceptance of Terms
By accessing or using MemoryVault ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
MemoryVault is a digital platform that allows users to create personalized 3D immersive museums featuring their photos and memories. The Service provides a unique shareable link for each vault created.
3. User Accounts and Content
You are responsible for all content you upload to the Service, including photos, text, and any other materials. By uploading content, you represent that:
- You own or have the necessary rights to use and share the content.
- The content does not violate any third-party rights, including intellectual property or privacy rights.
- The content does not contain illegal, harmful, or offensive material.
4. Payment and Pricing
The Service is offered as a one-time payment, not a subscription. Nothing is charged again automatically. Pricing is displayed at the time of purchase and may be subject to promotional discounts.
- All payments are processed securely through our payment provider. We never see or store your card details.
- Prices are listed in USD unless otherwise specified.
- Optional add-ons offered at checkout (such as extra photo slots) are also one-time charges.
- Promotional pricing and discounts are subject to change without notice.
5. How Long Your Museum Stays Online
Your purchase includes lifetime access. Your museum has no expiry date, there is nothing to renew, and no further charge will ever be made for it. You can keep editing it for as long as it exists.
- There is no subscription behind this purchase, so there is nothing to cancel and no card kept on file for a later charge.
- “Lifetime” means the lifetime of the Service. If we ever have to discontinue it, we will give at least 30 days' notice by email, so you can download your photographs and your exhibition pass first.
- Museums bought before this policy took effect were sold with one year of access. Those keep the terms they were sold under and can be renewed — write to us if you would like yours looked at.
- Unfinished drafts: if you build a museum but do not complete payment, we keep it for about 72 hours so you can come back and finish it — we email you a link to do so — and then delete it along with its photos.
Because a museum is often a gift, we recommend downloading or printing the exhibition pass and keeping your own copies of the original photographs. The Service is a way to present your memories, not a backup service for them.
6. Intellectual Property
You retain ownership of all content you upload to MemoryVault. By using the Service, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the Service. We do not claim ownership over your photos or personal content.
7. Service Availability
We strive to maintain the Service available at all times. However, we do not guarantee uninterrupted access and are not liable for any temporary unavailability due to maintenance, updates, or circumstances beyond our control.
8. Refund Policy
Consumers in the European Union, the EEA and the United Kingdom have a statutory right to withdraw from this purchase within 14 days, without giving any reason (Directive 2011/83/EU, Art. 9; UK Consumer Contracts Regulations 2013). Consumers in Brazil have 7 days from the date of purchase under Article 49 of the Consumer Protection Code (CDC).
MemoryVault is digital content delivered immediately. If you ask us to give you access straight away, you may be asked to expressly consent to immediate delivery and to acknowledge that you thereby lose your right of withdrawal once delivery has begun (Directive 2011/83/EU, Art. 16(m)). Where you have not given that consent, or where delivery has not yet begun, your withdrawal right applies in full and we refund you within 14 days of being informed.
To withdraw, or if a technical fault prevents you from using the Service, write to dreamgridbr@gmail.com. Nothing in these Terms limits any mandatory consumer right you have under the law of your country of residence.
9. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose.
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
- Attempt to gain unauthorized access to the Service or its related systems.
- Use the Service to distribute spam, malware, or any form of unsolicited content.
10. Limitation of Liability
To the maximum extent permitted by law, MemoryVault and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the updated terms.
